Garden sheds made by Harts Timber Sheds.
Terms and Conditions
These Terms and Conditions apply to the supply of garden sheds and other timber
buildings by Harts Timber Sheds.
Harts Timber Sheds is a trading name of
Harts Timber Buildings.
1. About Us
Harts Timber Sheds manufactures and supplies wooden garden sheds and timber buildings.
These terms apply when you place an order with us by telephone, email, at a display
site or by another method agreed with us.
2. Orders
- All orders are subject to acceptance by Harts Timber Sheds.
- We will confirm the shed size, roof style, door and window layout and any
other agreed options before manufacture or delivery. - Please check the details of your order carefully and tell us as soon as
possible if anything is incorrect. - Any quotation is normally valid for 30 days unless otherwise stated.
3. Prices
- The price payable will be the price agreed when your order is accepted.
- Prices shown to consumers are inclusive of VAT where applicable unless
clearly stated otherwise. - We make every reasonable effort to ensure that prices and product
information are correct. - If an obvious pricing or description error is discovered before an order
is accepted, we will explain the error and confirm the correct information
before proceeding.
4. Payment
For standard sheds, payment is normally made in full after the shed has been delivered
to your chosen location and professionally assembled, unless another arrangement has
been agreed with you.
Payment may be made by cash, cheque or bank transfer where agreed.
We do not take payment through ShedsBolton.co.uk and we do not collect payment-card
details through this website.
5. Deposits
A deposit may sometimes be required, including where an order is placed through a
display site or where a shed is being manufactured to a genuinely bespoke or
non-standard specification.
The amount of any deposit and the reason for it will be explained when the order
is placed.
If you cancel an order after work has begun, we may retain all or part of a deposit
only to the extent reasonably necessary to cover costs and losses arising directly
from the cancellation.
This may include materials already purchased or committed, manufacturing work already
completed and other reasonable losses that cannot be recovered by selling the building
to another customer.
We will take reasonable steps to reduce any loss, including considering whether the
building can reasonably be resold.
Nothing in this section affects your statutory consumer rights.
6. Bespoke and Non-Standard Buildings
A shed will only be treated as genuinely bespoke where it is manufactured to a
customer’s particular non-standard specification rather than simply selected from
our normal range of standard sizes and options.
Where a building is genuinely made to your individual specification or clearly
personalised, statutory cancellation rights that would otherwise apply to some
distance or off-premises contracts may not apply.
We will make it clear before manufacture begins where we consider an order to be
genuinely bespoke.
7. Cancellation Rights
Your cancellation rights depend on how and where the contract was entered into and
whether the building is a standard product or genuinely made to your individual
specification.
Where you have a statutory right to cancel, nothing in these Terms and Conditions
removes or restricts that right.
If you wish to cancel an order, please contact us as soon as possible so that we
can tell you what work, if any, has already been carried out.
8. Delivery and Assembly
Free delivery and professional assembly are included with our standard sheds within
our normal delivery area unless we have clearly agreed otherwise with you.
We will arrange a delivery date with you. Any delivery date is given in good faith,
but circumstances outside our reasonable control may occasionally cause a delay.
If this happens, we will contact you and arrange the next suitable date.
9. Access to Your Garden
You are responsible for making sure that there is safe and adequate access from the
delivery vehicle to the place where the shed is to be assembled.
Please tell us before ordering about narrow passages, steps, height restrictions,
restricted access, difficult ground conditions or anything else that could affect
delivery or assembly.
If we cannot safely deliver or assemble the shed because access is substantially
different from what we were told, we may need to postpone the installation.
Any reasonable additional costs will be explained to you before further work is
carried out.
10. Shed Base
The customer is responsible for providing a suitable, firm and level base ready
before delivery unless we have specifically agreed otherwise.
An unsuitable or uneven base can affect the operation, stability and lifespan of
the building.
If the base is unsuitable when we arrive, we may be unable to assemble the shed
until the problem has been corrected.
11. Product Appearance and Timber
Timber is a natural material. Variations in grain, colour, knots and minor movement
are normal characteristics of timber and do not necessarily indicate a defect.
Timber buildings require reasonable ongoing maintenance and protection from the
weather.
12. Our 12-Month Guarantee
Every garden shed we sell comes with a 12-month guarantee covering defects in
materials and workmanship.
This includes defects in items such as doors, floor boards and roof construction.
If a roof leak is caused by a defect in materials or workmanship, the defective
part will be repaired or replaced as appropriate.
The guarantee does not cover problems caused by:
- Misuse or accidental damage
- An inadequate, unstable or unsuitable base or foundation
- Lack of reasonable maintenance
- Alterations or damage carried out by someone else
- Normal characteristics or movement of natural timber
This 12-month guarantee is in addition to your statutory consumer rights and does
not replace or restrict them.
13. Your Statutory Rights
Goods supplied to consumers must be as described, of satisfactory quality and fit
for their intended purpose.
Assembly and other services must also be carried out with reasonable care and skill.
Nothing in these Terms and Conditions excludes or restricts rights that cannot
lawfully be excluded under UK consumer law.
14. Problems or Complaints
If there is a problem with your shed or its assembly, please contact us as soon as
reasonably possible and give us an opportunity to inspect and resolve the problem.
We aim to deal with genuine problems fairly and promptly.
15. Events Outside Our Reasonable Control
We will not be responsible for a delay caused by circumstances outside our reasonable
control, such as severe weather, road closures or other events that prevent safe
delivery or assembly.
Where this happens, we will contact you and make reasonable arrangements for a new
delivery or assembly date.
16. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Nothing in these terms affects any mandatory rights you have as a consumer.
